Big News For Govt Employees, Change in This Rule Related To Pension

7th Pay Commission: On the second day of the new year, the central government has announced an important change in the rules related to pension. A woman government employee or pensioner can now nominate her Kids for family pension before her husband in cases of marital discord, the Ministry of Personnel, Public Grievances and Pensions announced on Tuesday. At present, after the death of a government employee, family pension is first given to his spouse. The new rule of the government will provide relief to those women employees who do not get along with their husbands. Such women will be able to secure the future of their Kids.

What are the rules now?

As per the provisions of sub-rules (8) and (9) of Rule 50 of the CCS (Pension) Rules, 2021, if the spouse of a deceased Government servant or pensioner is in the family. So family pension is given to the husband or wife first. Only after this the Kids and other family members are eligible for family pension. This applies only then. When the spouse of the deceased government employee/pensioner is ineligible for family pension. Or they die.

Under what circumstances will relief be given?

The decision has been taken. That if divorce proceedings are pending in the court in respect of any government female employee/female pensioner. Or a female government employee/female pensioner has filed a case of domestic violence against her husband. Such a Government woman employee/woman pensioner may, after her death, give preference to her eligible child/Kidsfor payment of family pension over her husband. However, there are some conditions for this also.

Where the deceased female government employee/female pensioner has a husband in the family. And his Kids are eligible. Or is. Family pension will be payable to such Kids. At the same time, there is a widower i.e. husband in the family of the deceased government female employee/female pensioner. And no child is eligible for family pension on the date of death of the female employee. There family pension will be payable to the widower.

Where the family of the deceased government female employee/female pensioner consists of a widower along with minor child/Kidsor a child/Kidssuffering from mental disorder or disability. In such a case, family pension is payable to the husband. Provided that he is the guardian of such child/Kids.

If the widower ceases to be the guardian of such child/Kids. In such a situation, family pension will be payable to the child through the person who is the actual guardian of such child/Kids. Where a minor child, after attaining majority, is eligible for family pension, family pension to such child shall be payable from the date on which he attains majority.
